These Terms & Conditions govern your access to and use of The Capt App, a digital service connecting boat owners and captains. By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
1. Platform Purpose
The Capt App provides a digital marketplace connecting boat owners (“Owners”) with boat captains (“Captains”) for potential boating services, captain services, and related communication.
The Capt App acts solely as a technology platform facilitating introductions, bids, and communications between users. The Capt App is not a party to agreements entered into between Owners and Captains.
2. Eligibility
Users must be at least 18 years old, provide accurate account information, maintain current contact details, and use the Platform lawfully.
Captains are responsible for ensuring they possess any required licenses, certifications, insurance, or qualifications applicable to services they provide. Owners are responsible for independently verifying qualifications before hiring a Captain.
3. Accounts
Users are responsible for maintaining account security, protecting passwords, ensuring the accuracy of profile information, and all activity occurring under their account.
We reserve the right to suspend or terminate accounts that violate these Terms or create risk for the Platform or other users.
4. Memberships & Payments
Captain Accounts
Captain accounts are currently free.
Owner Memberships
Owners may optionally purchase a recurring monthly membership to access premium functionality, which may include receiving captain bids, direct captain communications, enhanced hiring functionality, and additional premium features introduced by the Platform.
Membership pricing will be displayed within the App before purchase.
Cancellation
Members may cancel at any time. Cancellation prevents future monthly renewals. Access may continue through the current billing period unless otherwise stated.
No prorated refunds are guaranteed unless required by law. We reserve the right to modify pricing with reasonable notice.
5. Communications Consent
Users expressly opt in to communications facilitated by the Platform. Communications may include in-app messaging, bid notifications, service inquiries, account notifications, transaction-related communications, and optional marketing communications where separately consented.
Users may adjust communication preferences where available.
6. No Employment Relationship
The Capt App does not employ Captains. Captains operate independently and are solely responsible for taxes, insurance, licensing, compliance obligations, service quality, and conduct.
Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship.
7. No Guarantee of Services
The Capt App does not guarantee availability of Captains or Owners, service quality, service completion, user compatibility, captain qualifications, or safety outcomes.
Users assume responsibility for conducting their own due diligence before entering into any service arrangement.
8. User Conduct
Users may not:
- Submit false or misleading information;
- Harass, threaten, or abuse other users;
- Circumvent Platform payment or communication systems where prohibited;
- Use the Platform unlawfully;
- Upload malicious software or harmful content;
- Misrepresent qualifications, licensing, credentials, or experience;
- Attempt unauthorized access to the Platform or related systems.
We may remove content or suspend accounts for violations of these Terms.
9. Vessel Safety & Boating Risk Disclaimer
Users acknowledge that boating activities involve inherent risks, including personal injury, property damage, equipment failure, weather-related hazards, water conditions, operator error, mechanical failures, and maritime emergencies.
The Capt App does not own, inspect, maintain, certify, endorse, or supervise vessels listed or utilized through the Platform.
Boat Owners remain solely responsible for vessel seaworthiness, vessel maintenance, safety equipment compliance, insurance coverage, and compliance with federal, state, and local maritime laws. Captains remain solely responsible for operating vessels safely and lawfully.
Users assume all risks associated with boating activities arranged through or connected to the Platform.
10. Captain Credentials & Verification Disclaimer
The Capt App may permit Captains to provide information regarding licenses, credentials, certifications, training, insurance, or boating experience.
Unless expressly stated by the Platform in writing, The Capt App does not independently verify captain licensing status, maritime certifications, insurance coverage, experience claims, safety qualifications, or background information.
Owners are solely responsible for conducting independent due diligence before hiring any Captain. Captains are solely responsible for ensuring compliance with all applicable licensing and regulatory requirements.
The Capt App makes no representation regarding Captain qualifications.
11. Payment Processing & Refund Policy
Membership payments may be processed through third-party payment processors. By purchasing a membership, users authorize recurring monthly billing until cancellation.
Users may cancel memberships at any time through account settings or available cancellation methods. Cancellation prevents future billing cycles but does not automatically entitle users to refunds for current billing periods.
Chargebacks initiated without first contacting customer support regarding legitimate concerns may result in account suspension or termination. The Capt App reserves the right to investigate disputed charges.
Refunds, if issued, remain solely within Company discretion unless otherwise required by law.
12. Insurance Disclaimer
The Capt App does not provide maritime insurance, liability insurance, vessel coverage, captain coverage, or trip protection.
Boat Owners and Captains are solely responsible for maintaining insurance appropriate to their activities. Users acknowledge that boating operations may expose participants to substantial liability and financial risk.
13. Intellectual Property & User Content
The Capt App and all associated technology, branding, software, text, graphics, logos, interfaces, and Platform functionality are owned by The Capt App or its licensors and protected by intellectual property laws.
Users retain ownership of content they submit, including profile information, vessel information, images, messages, reviews, and other user-generated content.
By submitting content, users grant The Capt App a non-exclusive, royalty-free, worldwide license to host, display, process, and use such content solely for operating, maintaining, and improving Platform services.
Users represent they possess the rights necessary to upload submitted content. Users may not copy Platform code, reverse engineer services, reproduce Platform branding, or scrape Platform data without permission.
14. Copyright & DMCA Compliance
If users believe copyrighted material has been improperly posted on the Platform, notices may be submitted to:
Notices should include identification of the copyrighted work, identification of the allegedly infringing material, contact information, a good-faith statement, and a statement under penalty of perjury of ownership authority.
The Company reserves the right to remove allegedly infringing content.
15. Platform Availability
The Company does not guarantee uninterrupted Platform availability. The Platform may experience maintenance outages, technical failures, feature modifications, and service interruptions.
The Company reserves the right to modify, suspend, or discontinue features at any time.
16. Termination
The Company may suspend or terminate accounts immediately for fraudulent conduct, misrepresentation, safety concerns, harassment, non-payment, or violation of these Terms.
Termination does not relieve users of outstanding payment obligations.
17. Disclaimers
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.”
To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, continuous availability, and accuracy of user content.
18. Limitation of Liability
To the fullest extent permitted by law, The Capt App shall not be liable for injuries, property damage, captain performance, owner conduct, lost profits, indirect damages, service interruptions, user disputes, or boating-related incidents arising from arrangements made through the Platform.
Total liability shall not exceed amounts paid by the user to The Capt App during the preceding twelve months.
19. Indemnification
Users agree to indemnify and hold harmless The Capt App, its owners, employees, contractors, affiliates, and service providers from claims arising from user conduct, service arrangements, violations of law, boating incidents, or breach of these Terms.
20. Dispute Resolution & Arbitration
Before initiating formal legal proceedings, users agree to attempt good-faith resolution by contacting:
If disputes cannot be resolved informally, any claim arising from Platform use shall be resolved through binding arbitration administered under applicable arbitration rules.
Users waive rights to jury trials, class actions, and representative lawsuits. Claims must be brought individually.
Nothing herein prevents either party from seeking equitable relief regarding intellectual property violations or misuse of confidential information.
If arbitration provisions are determined unenforceable under applicable law, disputes shall be resolved exclusively in courts located within [Insert State].
21. Modifications
We may update these Terms periodically. Continued Platform use after changes constitutes acceptance of revised Terms.
22. Governing Law
